State representative Marty Flynn settles trip and fall lawsuit

A state representative from West Scranton has settled his lawsuit against the owner of a West Scranton home.

Before he was elected to represent West Scranton and nearby communities, Marty Flynn was jogging on March 22, 2011 by 641 N. Main Ave. when he tripped and fell because of an uneven sidewalk.

In an interview Tuesday, Mr. Flynn said the claim was settled for $566.

"The money went to my chiropractor," Mr. Flynn, D-113, said. "The whole thing was I just wanted my medical bills covered when I wasn't insured. ... That's all I wanted from the get-go was to get my bills taken care of."

While he had health care coverage when he fell, Mr. Flynn said he lost his coverage after leaving his job at the Lackawanna County Prison. He still, however, needed to seek treatment for injuries because of the fall after he lost his coverage, he said.

A court record filed Monday indicated a settlement had been reached, though it did not provide any specifics. The suit was filed in November in Lackawanna County Court after Mr. Flynn was elected.

The suit named Jackie Lavelle and Lori A. Trager, whom it stated lived at 641 N. Main Ave. It also named the home's owners, Phillip Scavo and Arlene Scavo.

According to court papers filed by Ms. Scavo's attorney, Mr. Scavo is deceased. Ms. Lavelle and Ms. Trager did not live at the home at the time of the incident, court papers stated.

Efforts to reach Ms. Scavo's attorney, Joseph Pulcini Jr., on Tuesday were unsuccessful.

The suit stated the defendants had an obligation to ensure the sidewalk was safe rather than in a "dangerous and defective condition."
