Wyoming County sentencings for Friday, Oct. 12

TUNKHANNOCK - A 28-year-old Clarks Summit woman will spend at least a year in state prison after being sentenced for her involvement in kicking a Wyoming County sheriff's deputy last summer.

Jessica Maria Demark of Silver Meadow Lane told President Judge Russell Shurtleff, "I apologize to the court and community for my actions."

But her attorney, Deborah Albert-Heise, said her client had a "very bad alcohol addiction" and "has no recollection of the events that transpired" the day she was arrested.

Court documents note that on July 12, 2011, Ms. Demark was in the same county courthouse where she was sentenced Friday and was "staggering uncontrollably."

Deputy Nick Rock called for backup from Tunkhannock Patrolman Dustin Cokely after Ms. Demark allegedly began swearing.

She was escorted to her husband's vehicle, and according to a police complaint, kicked Deputy Rock.

Judge Shurtleff gave Ms. Demark credit for 73 days served in the county jail. However, he noted that the 12- to 24-month sentence in state prison and $500 fine was appropriate "as you risked the health and safety of a law enforcement officer."

Other sentences

Other sentences handed down:

n Andrew D. Allen, 41, of Tunkhannock, was sentenced to 18 months' probation and a $1,000 fine for indecent assault on May 6.

n Lawrence DeHart Allen, 52, of Laceyville, was sentenced to a $300 fine for possession of a small amount of marijuana on April 13.

n Mary Louise Berchem, 32, of Tunkhannock, was sentenced to six months' probation and a $300 fine for DUI on Jan. 27.

n Cody Alan Brown, 22, of Tunkhannock, was sentenced to 22 days to 12 months in county jail and $250 restitution for receiving stolen property on Sept. 6, 2011; and to 91 days to six months in county jail and a $500 fine for possession of drug paraphernalia on July 20. The sentences are to be served consecutively.

n Stanley J. Ely Jr., 48, of Tunkhannock, was sentenced to 12 months' probation and a $500 fine for theft by deception on April 12.

n Christopher Peter Fischi, 45, was sentenced to 44 days to six months in county jail and a $1,000 fine for DUI on March 29, 2008.

n Michael D. Harrison, 42, of Tunkhannock, was sentenced to 30 days to six months in county jail and a $1,000 fine for DUI on June 18, 2011.

n Jesse Ray Helwig, 21, of Tunkhannock, was sentenced to 10 to 23.5 months in county jail and $5,739 in restitution for a burglary on Jan. 2; and to 10 to 23.5 months in county jail and $3,901.53 in restitution for a burglary on Jan. 9. The sentences are to be served concurrently.

n Andrew M. Inman, 28, of Courtdale, was sentenced to five years' intermediate punishment, 90 days' house arrest and $1,500 fine for DUI, second offense, on Jan. 27.

n Samantha Lee Murphy, 25, of Tunkhannock, was sentenced to 62 days to 12 months in county prison and a $300 fine for possession of drug paraphernalia on April 9.

n Marcus E. Spickerman, 26, of Nicholson, was sentenced to six months' probation and a $300 fine for DUI, and to 12 months' probation and restitution of $26,999.14 for unauthorized use of a motor vehicle on July 29, 2011.

n Cindy Lou Vandermark, 51, of Dalton, was sentenced to 60 days to 12 months in county prison, a $300 fine and $82.17 in restitution for retail theft on March 15, 2008.

n Philip M. Warfle was sentenced to 26 days to 12 months in county prison, a $500 fine, and $175 restitution for criminal conspiracy to commit criminal trespass on April 10, and 12 months' probation and a $500 fine for theft from a motor vehicle on April 11. The sentences are to be served concurrently.
