Developments in the Lee case

Dec. 9, 2009: Herbert Lee is found dead in the kitchen of his Lake Twp. home with a single gunshot wound to his head. Authorities charge his then-15-year-old great-grandson, Cody Lee, with an open count of homicide.

April 8, 2010: A judge bars prosecutors from using statements Mr. Lee gave to police following the shooting. The judge says Mr. Lee's judgment had been clouded from fleeing his home and roaming through the woods in the near-freezing cold for eight hours before police caught up with him.

Dec. 23, 2010: The state Superior Court upholds the decision to bar prosecutors from using Mr. Lee's statements to police.

Aug. 6: A judge rules Mr. Lee will go on trial as an adult, rejecting a defense motion to transfer the criminal proceedings to juvenile court.

Jan. 11: Investigators immediately rearrest and recharge Mr. Lee after Magisterial District Judge James E. Tupper dismisses an open count of homicide against him.

Feb. 15: At a second preliminary hearing, Magisterial District Judge Paul Roberts Jr. finds prosecutors have met a fundamental threshold of evidence to send Mr. Lee to trial in the Court of Common Pleas.
