Baseball player's family sues over injuries

A Dickson City couple is suing several baseball groups after their son was injured last summer while attempting to do a pull-up in a Little League dugout in Sterling Twp., Wayne County.

Betty and Indelgardo Colon are suing the Spring Hill Foundation, Western Wayne Little League, Dickson City Little League and Little League International after their son Indelgardo DeCarlos Colon was injured June 4, 2011, when he grabbed a concrete lintel, which dislodged, causing it to fall on the boy and causing him serious injuries, according to a lawsuit filed in Lackawanna County Court on Monday.

Indelgardo suffered injuries including multiple rib fractures, a lacerated liver, a spleen injury and an upper abdominal hernia that resulted in medical bills estimated at more than $1 million, according to the lawsuit filed by attorney Stephen Fendler.

According to the lawsuit, seven to 10 days before Indelgardo was injured, a storm hit the area, blowing off the roof and damaging the dugout - damage the defendants never had professionally inspected or repaired.

The plaintiffs are seeking more than $50,000, plus costs and interest, on each of three separate counts on the part of the defendants for failing to maintain the dugout, allowing players to enter the dugout despite knowing the roof had blown off, and failure to warn Indelgardo the concrete lintel was unsafe and unstable, according to the lawsuit.
